1 Introduction

2 Ordering goods from us

2.1 Below, we set out how a legally binding contract between you and us is made.

You will need to register on the site with information about yourself which is accurate, current and complete. The password you provide should be kept secure and yo must notify us of any breach of security or unauthorised use of your account.

You place an order on the site by adding your selected item(s) to the shopping bag and proceeding to checkout. Items in your shopping bag are not reserved and may be purchased by another customer. Please read and check your order carefully before submitting it.

2.3.1

When you place your order at the end of the online checkout process (i.e. when you click on "Pay"), we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted.

2.3.2

We may contact you to say that we do not accept your order. This is typically for the following reasons:

(a) the goods are unavailable;

(b) we cannot authorise your payment;

(c) you are not allowed to buy the goods from us;

3 Delivery

3.1 Once you have placed an order, this cannot be cancelled at any stage. The contract is completed on receipt of the order.

3.2 We will deliver your purchases using the delivery method that you select during the checkout process.

3.3

The estimated date for delivery of the goods is set out in the Confirmation Email (see clause 3.2.3). This date is an estimate only and we do not guarantee to deliver the goods on that date.

3.4

We require that all deliveries are signed for by a person at the delivery address. You agree that delivery takes place when the goods are signed for at the delivery address and the signature of the person at the delivery address is conclusive evidence that the signed-for goods have been delivered to you at that address.

3.5

If nobody is available to take delivery, please contact us using the contact details at the top of this page to arrange an alternative delivery, Unless you and we agree otherwise, if we cannot deliver your goods.

3.5.1 let you know;

3.5.3 give you a refund.

3.6 We may deliver your goods in instalments.

4 Payment

4.1

We accept the following payment methods: Visa, MasterCard, American Express, Visa Debit, Visa Delta, Electron and PayPal. We do not accept any other method of payment.

We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

4.3 Your credit card or debit card will only be charged when the goods are dispatched.

4.4

The price of the goods is in the currency shown at the checkout. You are responsible for any charges that your payment card provider may apply for making payment in that currency.

4.5 The price of the goods does not include the price of delivery, which will be shown separately at the checkout and on the Confirmation Email.

4.6 If the shipping address of your goods is in India the price of the goods includes sales tax and duties.

5 Nature of the goods

5.1

While we try to make sure that all weights, sizes and measurements set out on the site are accurate, there may be small differences between the weights, sizes and measurements of goods shown on the website and the actual goods we supply.

5.2

While we try to make sure that the colours of our goods are displayed accurately on the site, the actual colours that you see on your computer may vary depending on the monitor that you use.

5.3

Many of our garments are hand finished or hand embroidered. By their nature these garments may exhibit small irregularities and may vary from examples shown on the website; this is not a manufacturing fault. Garments featuring hand embroidery or hand finishing or incorporating fabrics such as chiffon and georgette are by their nature susceptible to pulls and rips and are not designed for hard wearing.

5.4 The packaging of the goods may be different from that shown on the site.

6 Made-to-measure and altered garments

6.1

We produce made-to-measure garments and alterations to ready-made garments according to the specifications that you provide when you place your order. If you wish to change your specifications after we confirm your order you must contact us at customercare@aashniandco.com as soon as possible. If you contact us before the garments have been dispatched we will use reasonable efforts to accommodate the change. We may charge an additional fee for accommodating the change.

7 Returns or Exchanges

7.1

This clause 7 sets out the only circumstances in which we will accept returns or offer refunds for goods. We will not accept returns or offer refunds for goods unless they are faulty. For this purpose, the customer needs to notify us within 7 days from the date of delivery.

7.2

If your goods are faulty when they are delivered you may return the faulty goods to us. If you return the goods to us we will (at our option) repair or replace the goods or provide you with a refund of the purchase price and the price of delivery.

7.3

In order to return faulty goods you must contact us at customercare@aashniandco.com to inform us that you wish to return the goods. We will then provide you with details of where to return the goods and how to complete the returns process. You will be responsible for the costs of delivering the goods back to us.

7.4

If we repair or replace the goods we will deliver the repaired or replaced goods to you at no additional cost to the delivery address you specified when you purchased the goods.

7.5

If we provide a refund we will pay it to the account you used to purchase the goods. Subject to outfit being unused and unworn with all the tags intact as at the time of receiving the outfit.

8 End of the contract

If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

9 Limit on our responsibility to you

9.1

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for:

9.1.1 losses that:

(a) were not foreseeable to us when the contract was formed; or

(b) that were not caused by any breach on our part;

9.1.2 business losses.

9.2

Except for any legal responsibility that we cannot limit in law (such as for death or personal injury), our whole liability to you in connection with your purchase will be limited to the amount that you paid us for the goods and delivery.

10 Disputes

10.1 We will try to resolve any disputes with you quickly and efficiently.

10.2 If you are unhappy with the goods, our service to you, or any other matter, please contact us as soon as possible.

10.3 If you want to take court proceedings, the courts of India will have exclusive jurisdiction in relation to this contract.

10.4 Indian law will govern this contract and any claims or disputes arising out of or in connection with it (including non-contractual claims and disputes).

11 Content

"Content" is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this site. We try to ensure that the information on this site is accurate and complete. But we do not promise that our Content is accurate or error-free. We cannot guarantee that our content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the internet ensure they have up to date virus checking software installed. We may, with or without prior notice, terminate any of the rights granted by these terms. 14 Discounts & Promotions

Discounts differ on individual products and will be considered for final invoicing irrespective of material used for promotional purpose.
We are unable to offer price adjustment on items originally purchased in a sale or on any special promotion items that are temporarily reduced in price. Once an item has been purchased at a discounted sale price, no price adjustment will be offered should the item be further marked-down.
Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided.

Many of our garments are hand finished or hand embroidered. By their nature these garments may exhibit small irregularities and may vary from examples shown on the website; this is not a manufacturing fault. Garments featuring hand embroidery or hand finishing or incorporating fabrics such as chiffon and georgette are by their nature susceptible to pulls and rips and are not designed for hard wearing.

5.4 The packaging of the goods may be different from that shown on the site.

6 Made-to-measure and altered garments

6.1

We produce made-to-measure garments and alterations to ready-made garments according to the specifications that you provide when you place your order. If you wish to change your specifications after we confirm your order you must contact us at customercare@aashniandco.com as soon as possible. If you contact us before the garments have been dispatched we will use reasonable efforts to accommodate the change. We may charge an additional fee for accommodating the change.

7 Returns or Exchanges

7.1

This clause 7 sets out the only circumstances in which we will accept returns or offer refunds for goods. We will not accept returns or offer refunds for goods unless they are faulty. For this purpose, the customer needs to notify us within 7 days from the date of delivery.

7.2

If your goods are faulty when they are delivered you may return the faulty goods to us. If you return the goods to us we will (at our option) repair or replace the goods or provide you with a refund of the purchase price and the price of delivery.

7.3

In order to return faulty goods you must contact us at customercare@aashniandco.com to inform us that you wish to return the goods. We will then provide you with details of where to return the goods and how to complete the returns process. You will be responsible for the costs of delivering the goods back to us.

7.4

If we repair or replace the goods we will deliver the repaired or replaced goods to you at no additional cost to the delivery address you specified when you purchased the goods.

7.5 If we provide a refund we will pay it to the account you used to purchase the goods.

8 End of the contract

If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.

9 Limit on our responsibility to you

9.1 9.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for:

9.1.1 losses that:

(a) were not foreseeable to us when the contract was formed; or

(b) that were not caused by any breach on our part;

9.1.2 business losses.

9.2

Except for any legal responsibility that we cannot limit in law (such as for death or personal injury), our whole liability to you in connection with your purchase will be limited to the amount that you paid us for the goods and delivery.

10 Disputes

10.1 We will try to resolve any disputes with you quickly and efficiently.

10.2 If you are unhappy with the goods, our service to you, or any other matter, please contact us as soon as possible.

10.3 If you want to take court proceedings, the courts of India will have exclusive jurisdiction in relation to this contract.

10.4 Indian law will govern this contract and any claims or disputes arising out of or in connection with it (including non-contractual claims and disputes).

Content" is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this site. We try to ensure that the information on this site is accurate and complete. But we do not promise that our Content is accurate or error-free. We cannot guarantee that our content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the internet ensure they have up to date virus checking software installed. Your use of the site and its content grants no rights to you in relation to any intellectual property rights relating to the Content All such content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this site are protected by national intellectual property and other laws and international treaty provisions. We may, with or without prior notice, terminate any of the rights granted by these terms. 14 Discounts & Promotions

Discounts differ on individual products and will be considered for final invoicing irrespective of material used for promotional purpose.
We are unable to offer price adjustment on items originally purchased in a sale or on any special promotion items that are temporarily reduced in price. Once an item has been purchased at a discounted sale price, no price adjustment will be offered should the item be further marked-down.
Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided.

HOW YOU CAN ACCESS AND IF NECESSARY, CHANGE THE PERSONAL INFORMATION AASHNI + CO MAINTAINS

If for any reason you are concerned that the personal information held by AASHNI + CO is not correct, please visit the website and, after logging into the site using the "Sign In" menu on the home page, your personal information will be made available for review and change in the "My Account" section. Only you or, upon your request, the Customer Care department, may access your personal data from the website using your password and User ID. Information may be changed online within My Details, Shipping Details, and My Email Preferences. You can change or delete saved credit/debit card details each time you make a purchase. You will also be able to delete saved credit/debit card details by adding or editing a shipping/billing address. If you change your billing or shipping address while your order is still being processed, the order may be re-processed through security validation checks. Returns and Exchanges

HOW TO RETURN AN ITEM

To return or exchange a product please email us the order# with product codes to customercare@aashniandco.com and we will help you with the process. Alternatively you can call us on +91- 8375036648 on Monday to Friday between 10am-6:00pm and Saturday between 1pm to 6pm. Your purchase should be sent back to us within 14 days of receiving your order.

Our team will provide you with a Return merchandise Authorization Number (RMA) following which you can simply fill up our online returns form quoting the RAN no and ship the item back to us. You will be notified by email once your return has been received and processed.. For details on which items qualify for a refund, please read our Returns Policy below.

REFUNDS

All successfully returned items can be exchanged for other merchandise or online store credit. RETURNS POLICY

Please check the item refund policy below the item before placing an order. Returns that do not meet our policy will not be accepted and sent back to the customer. Made to Order/Measure/Custom/Bespoke items, Accessories and Bags do not qualify for a refund, store credit or an exchange. Customer is advised to check the ordered products and quantity in the invoice prior to accepting the package from the logistics/courier. In case of a discrepancy we request you to leave a remark with the logistics/courier company and notify us on customercare@aashniandco.com with the discrepancy details within 24 hours of accepting the package. In case of the discrepancy found correct, Aashni + Co will follow the policy of Repair following Replace and finally Store Credit if the item cannot be repaired or replaced. All other items can be returned in exchange for another item or online store credit.

Items should be returned unused and with all AASHNI + CO, designer garment tags still attached to the item. Loose tags or broken tags will not be accepted for an exchange or credit note. Returns that are damaged or soiled may not be accepted and may be sent back to the customer and/or a refund refused. Where provided, belts and any designer packaging such as authenticity cards, dust bags, and leather tags should be included with your return along with all invoices and paperwork. All items returned should have a Return Merchandise Authorization (RMA) number to allow easy identification and prompt processing. Unidentified returns may be returned to the sender. We recommend that you insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our warehouse. In case of dispute, we also recommend you retain proof of sending. Refunds will be issued within 30 days of us receiving your cancellation notice.

Shoes All shoes should be tried on a carpeted surface before wear.

Beauty Skincare, cosmetics, hair care and fragrance must be returned unused, unopened, and in their original packaging otherwise we may not accept them.

Lingerie & Swimwear Briefs, swimming costumes and bikini bottoms should be tried on over underwear, without removing the protective adhesive strip. Returns may not be accepted if this strip has been removed or if items are soiled, and may be sent back to the customer.

Faulty goods

Goods are classified as faulty if they are received damaged, or where a manufacturing fault has occurred. Items that are damaged as a result of normal wear and tear are not considered to be faulty.

Colors

We have made every effort to display the colors of our products that appear on AASHNI + CO as accurately as possible. However, as computer monitors, tablets and mobile devices vary, we cannot guarantee that your monitor's display of a color will be completely accurate.

Return outside the 14 day window may be accepted at our discretion.

Before your parcel leaves our warehouse, it is fully checked and controlled by our packing team. If you receive an item, which is damaged, please contact us immediately. If your item is faulty (i.e. received damaged or manufacturing fault), we can offer alternatives such as repair or exchanges. For more information, please contact our Customer Care team. Where possible, we will offer to repair faulty items. If you would like to exchange your item, please be aware that we can only replace it for the same product in the same size, subject to availability. You will receive a credit note if the item cannot be repaired or replaced.

Made-to-Measure, Ready-made and Alteration - Terms and Conditions

The following are the terms and conditions which apply to sales of made-to-measure and Ready Made garments and also to alterations to ready-made garments, purchased from Aashni and Co Flagship Store at Ledbury Road, Notting Hill, London (“Aashni + Co ”) to you, (“the Customer”).

Made-to-measure garments are personally tailored to the Customer’s specifications and cannot be re-sold. Aashni + Co is therefore unable to accept any cancellation of an order for a made-to-measure item. Aashni + Co will make all reasonable efforts to accommodate any change to an existing order required by a Customer, but cannot guarantee to be able to do so, and reserves the right to make an additional charge to the Customer for any changes. Items purchased from Aashni + Co are non exchangeable and non refundable. The garment(s) purchased in store is(are) hand embroidered and hand finished. Due to the complex nature of the garment, embellishments may disintegrate from the fabric. This is not a manufacturing fault. Other fabrics such as chiffon and georgette are subject to pulls and rips as is the nature of the garment.

Made-to-measure items and alterations are custom made items to which the distance selling provisions of The Consumer Contracts (Information, Cancellation and Additional Charges) 2013 Regulations 2013 are not applicable.

If the customer is not satisfied with the quality of the delivered items(s), Aashni + Co will, following inspection of the goods, implement a strict policy of Repair, Replace and finally Refund, depending on which remedy is the most appropriate.

Orders for alterations to ready-made garments cannot be cancelled and any variation to an alteration order may be subject to an additional charge. Should Aashni + Co agree, in its absolute discretion, to accept a cancellation, it reserves the right to make a cancellation charge to the Customer.

In the event of any dispute as to whether a finished made-to-measure item or alteration to a ready-made item conforms with the Customer’s requirements, the description recorded on the Aashni + Co Order or Measurement Slip shall be final. Accuracy of measurements submitted to Aashni + Co by the Customer will be entirely at the Customer’s own risk.

The Customer agrees to attend a minimum of three fittings of the made-to-measure or altered ready-made garment. The first fitting shall take place after delivery of the item; the second fitting 21 days thereafter and the third fitting after a further 14 days. (Despatch times are excluded from the aforementioned timetable). All further fittings will be completed within 10 working days post the 3rd fitting.

Aashni + Co cannot guarantee delivery of a finished made-to-measure garment to the Customer within any particular time, but will normally deliver within 9 – 12 weeks of accepting the Customer’s order.

Customers must collect finished articles within 30 days of being advised by Aashni + Co that they are available for collection. Failure to collect within this time without the consent of Aashni + Co may result in the item being disposed off. Correspondence of delivery will be via electronic mail or contact details recorded on the form. Customers are requested to check the details thoroughly prior to submission.

Ownership of any garment shall not pass to the Customer until paid for in full.

The garment should be kept in a separate cover when not in use and not in contact with any other garment as direct contact with another embroidered outfit may damage it. The garment must be kept out of contact of water and perfumes as they may cause discoloration. The garment must be Dry Cleaned by a reputed dry cleaner company only.

Taxes and Duties

Taxes and duties are calculated according to your shipping destination and are borne by the customer.  Please note taxes and duties are chargeable as applicable.  Most countries are shipped to on a DDU (Delivery Duty Unpaid) basis, which means product prices displayed are exclusive of all taxes and duties. As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these is necessary to release your order from customs on arrival.   Please note we are unable to advise the duty amount.

If the country of shipment is within India, all prices are shown inclusive of tax. All other countries are shown a price excluding taxes.

Insurance

Aashni + Co insures each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes, then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by Aashni + Co and transfer of responsibility in the same way.

Important Information

Order cut-off times are provided as guidelines only, and do not take into account possible delays caused by payment authorization.
We aim to dispatch all orders within 24- 48 hours with the exception of made to measure orders.
Estimated delivery times are to be used as a guide only and commence from the date of dispatch. We are not responsible for any delays caused by destination customs clearance processes.
We are unable to redirect orders once items have been dispatched. All orders require a signature upon receipt.
